Season Pass Contract & Release Agreement
The Season Lift Pass is for your enjoyment, however Squaw Valley Ski Corp (SVSC) requires, as a condition of your being permitted to hold and use this Pass, that you understand and agree to the following provisions:
Terms And Conditions
- I agree that all Passes issued to me remain the property of SVSC and may be revoked, cancelled, or terminated at any time upon the breach of the following conditions of use.
- I understand that my participation in skiing/snowboarding at SVSC includes the risk of serious injury or death and other losses both to me and my property. I understand that serious injury or death or loss to property may result not only from my and/or my minor child’s actions, but the actions and negligence of others and may occur from any cause whatsoever, including, but not limited to, changes in snow or ice conditions, avalanches, collisions or encounters with other skiers/snowboarders or with natural obstacles, such as rocks, trees and cliffs, or with man-made obstacles and features such as terrain parks (including, but not limited to, jumps, halfpipes, quarterpipes, rails, and boxes), chairlift towers, snowmaking and snowgrooming equipment and snowmobiles (hereinafter “Risks”). As a condition of my or my minor child’s being permitted to hold and use this pass and the facilities at SVSC, I freely and expressly assume these risks.
- I will be actively aware of and obey all safety rules, signs, and regulations, and will familiarize myself with and obey the Skier’s Responsibility Code (also known as Your Responsibility Code) and the Placer County Skier’s Responsibility Code. I agree to heed all designated and/or posted “slow” and “caution” areas, and understand that failure to do so may result in revocation of all lift and skiing/snowboarding privileges without compensation. I understand that skiing or snowboarding out of ski area boundaries, or in closed areas is strictly prohibited and will result in immediate revocation of all lift and skiing/snowboarding privileges and confiscation of my season pass without compensation. I understand that if I do ski/snowboard out of bounds, I will be in violation of California Penal Code Section 602 and will thereby subject myself not only to possible penalties of a $500 fine and 6 months in jail, but also any cost of search and rescue, which may arise.
- I agree to carry the Pass with me at all times when I am skiing/snowboarding at SVSC and will present it for inspection at each lift ride.
- I understand and agree that use of my Pass by anyone other than myself will result in the immediate revocation of all lift and skiing/snowboarding privileges without compensation. I further understand that such use shall constitute fraud subjecting both parties to criminal prosecution.
- I agree that attempting to use my Bronze or Silver Pass on any day or night when it is not valid, as shown on this application, will result in immediate revocation of all lift and skiing/snowboarding privileges without compensation and will be considered fraud.
- I understand that my Pass and privileges to use the facilities of SVSC may be revoked at any time without compensation by the Professional Ski Patrol or SVSC Management for misconduct, illegal use, violating SVSC policies or nuisance caused by me.
- In the event my Pass is lost or stolen, I understand I must notify the Special Tickets Office and it may be replaced for a $100 charge. If I do not have the Pass with me for any reason, including loss, and I desire to ski/snowboard, I will have to purchase a daily lift ticket at the rate being charged to the general public.
- I understand my Pass is issued only for the 2009-10 winter season, as long as the lifts are in operation for skiing/snowboarding, or until May 31, 2010, whichever comes first. I understand that SVSC does not guarantee snow conditions or the number of usable days in the season and that refunds or credits are not available.
- The Preferred Parking Pass deposit is refundable upon return of pass in working condition. Your parking pass must be present in your vehicle in order to use preferred parking.
- I grant exclusive permission to Squaw Valley and their agents, clients and assigns to use my name, likeness, and photograph/film for the purpose of publicity, public relations, editorial, or other advertising purposes without restriction as to frequency or duration.
Release Of Liability And Indemnity Agreement
I understand and accept the fact that skiing/snowboarding in its various forms is a hazardous sport that has many dangers, including, but not limited to, the aforementioned Risks and involves the risk of injury and death. Despite the risks involved in the sport and in consideration of being allowed to participate in the sport, I AGREE TO EXPRESSLY ASSUME ANY AND ALL RISK OF INJURY OR DEATH which might be associated with these Risks, my or my child’s use of the equipment and participation in the sport and use of the facilities of SVSC and Squaw Valley Preserve, including, but not limited to, the use of equipment, the facilities, tubing park, ice rink, terrain parks, lessons, coaching, chairlifts, funitel, cable car and participation in instruction, racing, special events, and skiing or snowboarding beyond the ski area boundary and closed areas (hereinafter collectively referred to as “use of the facilities”). I agree, as a condition of being allowed to use the ski/snowboard area facility and premises, that I freely accept and voluntarily assume all risks of personal injury or death or property damage whether caused by the aforementioned Risks or by the NEGLIGENCE of SVSC, its agents or employees, directors, officers, and shareholders, and release SVSC and agree NEVER to sue its agents, employees, directors, officers, and shareholders. I also understand that this is a RELEASE OF LIABILITY which will prevent me, my children, or my heirs from filing a suit or making any claims for damages in the event of injury or death to me or my child. Additionally, in the event I, my child, the user, or my legal representative files a law suit arising out of the use of the facilities at SQUAW VALLEY, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS SVSC, for any damages, attorney’s fees or costs associated with or arising out of such a lawsuit. This release is valid forever. With the aforesaid fully understood, I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my heirs, assignees, and legal representatives. I also understand that this agreement will be interpreted pursuant to California law and any lawsuit will be filed within competent jurisdiction in Placer County, California.
I, the undersigned, have read and understand the terms and conditions of the Season Pass Contract and the Release Agreement set forth above. I sign freely and of my own accord, binding myself, my heirs and assignees. In the event that I am signing it on behalf of any minors, I confirm that I have full authority to do so thereby binding them as well as myself. I further understand that my season pass, locker and/or preferred parking pass, including the receipt, are NON TRANSFERABLE — NO REFUNDS — NO CREDITS for any reason.
